DMCA Policy
TechWave Designs ("us", "we", or "our") is committed to upholding the intellectual property rights of others and expects our users to share this commitment. In compliance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), we will promptly address claims of copyright infringement that arise from the use of our services, provided that such claims are reported to our designated Copyright Agent as specified in the example notice below.
DMCA Notice of Alleged Infringement ("Notice")
- 1. Clearly identify the copyrighted work that you believe has been infringed upon, or provide a representative list if this Notice pertains to multiple works.
- 2. Specify the material or link that you claim is infringing (or associated with infringing activity) and for which you seek to disable access, including at least the relevant URL on our Site or the exact location of the infringing material.
- 3. Include your company affiliation (if applicable), mailing address, phone number, and email address, if available.
- 4. Incorporate both of the following statements in the body of the Notice:
- * "I affirm that I hold a genuine belief that the use of the copyrighted material in question is not permitted by the copyright owner, its representative, or the law (e.g., as fair use)."
- * "I affirm that the information contained within this Notice is truthful and, under penalty of perjury, that I am either the copyright owner or am authorized to act on behalf of the copyright owner or of an exclusive right under the copyright being claimed."
- 5. Provide your full legal name along with your electronic or physical signature.

It is important to note that under Section 512(f) of the DMCA, any individual who knowingly misrepresents material or activity as being infringing may face liability.
Counter-Notification
If you believe that your content was wrongfully removed (or access to it was improperly disabled), or that you possess authorization from the copyright owner, their agent, or under the law to use the content, you may submit a counter-notice to our designated Copyright Agent with the following information:
- 1. Your physical or electronic signature;
- 2. Identification of the content that was removed or access to which was disabled, along with the location where it appeared prior to removal;
- 3. A statement affirming that you have a genuine belief that the content was removed or disabled due to an error or misidentification;
- 4. Your name, address, phone number, and e-mail address, a statement indicating your consent to the jurisdiction of the federal court in Seychelles, and a statement that you will accept service of process from the person who submitted the allegation of infringement.
Upon receipt of a counter-notice, our designated Copyright Agent may forward a copy to the original complainant, notifying them that we might restore the removed content or reinstate access within 10 business days. If the copyright owner does not pursue legal action against the content provider or user, the content may be reinstated at our discretion within 10 to 14 business days or more following the counter-notice.
Policy on Repeat Infringers
In alignment with the DMCA and related legal standards, we have instituted a policy of terminating, in suitable circumstances and at our sole discretion, users who are identified as repeat infringers. Additionally, we may choose to restrict access to the Site and/or terminate accounts of any users who infringe the intellectual property rights of others, regardless of prior infringement history.
